These Terms of Service govern your use of the website (www.chrisscottwines.com) and all purchases made from CHRIS SCOTT WINES LIMITED, trading as CHRIS SCOTT WINES (“we”, “us”, “our”). By accessing the website or placing an order, you agree to these terms. If you do not agree, please stop using our website. These Terms of Services may be amended from time to time.

PURCHASES

• You must be 18 years or older to purchase alcohol in compliance with the Sale and Supply of Alcohol Act 2012. It is your responsibility to ensure your access to our website and placing of orders is lawful. In New Zealand, you must be 18 years or older to access our website and place an order.  If you are in New Zealand and are not 18 years, please exit our website immediately.

• All orders are subject to availability and our acceptance.

• Prices are in New Zealand Dollars (NZD), inclusive of GST. Delivery charges apply.

• We reserve the right to amend prices without notice, however, the price charged to you will be the price displayed at the time you place your order.

• Product images on the website are for illustrative purposes only. Vintages, labels, or packaging may vary from the image displayed.

• We reserve the right to refuse or cancel any order placed due to incorrect pricing, information, if we are uncertain whether you meet the age requirement, or stock availability caused by technical error.

• If an order is cancelled after payment, we will issue a full refund.

• If the advertised vintage is sold out, we may supply a subsequent, comparable vintage, and will attempt to notify you prior to dispatch.DELIVERY

• We deliver within New Zealand only.

• Estimated delivery timeframe: 3 - 5 working days from order confirmation. This is an estimate only and is subject to change. We will notify you if there are significant delays as delivery timeframes may vary depending on the delivery area and how many cases of wine you order.

• We will contact you if for any reason we cannot deliver your wine products within the estimate delivery timeframe.  At this point, you may decide to cancel your order for a full refund or wait for your wine products to be delivered.

• We will inform you of the expected time frame for any pre-orders and will notify you if there are any changes.

• All deliveries require the signature of an individual aged 18+ and proof of age may be requested by the courier.

INTERNATIONAL

• Our website is available for New Zealand customers. For international deliveries please visit www.winecollective.direct who will be our approved reseller, and their terms and conditions apply to all international orders.

RISK AND TITLE

• Title to the wine products pass to you upon full payment. Risk of loss or damage to the wine products pass to you upon delivery, confirmed by the 18+ signature at the delivery address. Age identification may be required before delivery of your purchase if we are uncertain you meet the age requirement.

PAYMENT

• Full payment is required at checkout. We will not ship the wine products until your payment has cleared.

• Delivery is in addition to the product price.

• All transactions are processed in NZD.

CANCELLATIONS AND RETURNS

• Orders may be cancelled prior to dispatch by contacting us at wine@chrisscottwines.com. In this instance, refunds will be processed within 10 days of you cancelling your order.

• If wine products are faulty, damaged, or incorrect, please notify us within 7 days of delivery at wine@chrisscottwines.com for a refund.

• Returns for change of mind are not accepted.

• Your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 remain unaffected.

PRIVACY

• We collect and use personal information in accordance with our Privacy Policy

GENERAL

• The content on our website, including text, graphics, and images, is owned or licensed by us and is protected by copyright. It may not be used, reproduced, or distributed without our express written permission.

• If you create an account, you are responsible for maintaining the confidentiality of your password and restricting access.

• You agree to receive communications regarding your purchase electronically (via email). Formal notices are deemed received 24 hours after being sent to the provided email address, unless a non-delivery report is received.

• These Terms of Service are governed by New Zealand law. Disputes will be resolved in New Zealand courts.

LEGAL DISCLAIMERS

• To the maximum extent permitted by New Zealand law, our total liability for any claim arising from these Terms of Service or the supply of our wine products is limited to the total price of the wine products giving rise to the claim. Your rights under the Consumer Guarantees Act 1993 remain unaffected.

• We are not liable for any delay or failure to perform our obligations if caused by events beyond our reasonable control, including but not limited to Acts of God, war, strikes, natural disasters, malicious damage, epidemics or compliance with any law or government order, regulation or direction.
